      If you miss the deadlines to protest an assessment, there are other options.  You may still have the IRS consider whether you owe the tax.  There are several ways in which a taxpayer may protest a tax that has already been assessed against them.

     Often we have clients tell us that they missed a deadline or they moved and never received a notice that the IRS was planning to assess a tax against them. Or, they tried to represent themselves and the result was a big tax liability that they don't believe they owe.  Perhaps they believe that they owe something, but not what the IRS assessed against them. They may have had a representative that didn't adequately represent them.

     Whatever the case, the tax has been assessed and now the issue becomes what to do about it.  There are several options to protest a tax once it has been assessed.  Some of them are as follows:

  • Audit Reconsideration.  There is a little known procedure known as Audit Reconsideration.  The taxpayer may have records that the IRS was not aware of.  They may have discovered some documents that reflect on the amount owed.  The IRS might even be wrong.  In Audit Reconsideration, the taxpayer has the opportunity to demonstrate that they really don' owe the tax.  If successful, the tax will be abated and no longer owed.

  • Offer in Compromise.  An OIC may be filed based on Doubt as to Liability.  This will require the IRS to determine whether the tax is actually owed.  You may be able to settle for a small percentage of what is owed.
     

  • Tax Court.  If the assessment is caught in time, Tax Court is an option.  If the IRS made an assessment and you do not really owe the tax, you can go to Tax Court and have a Judge determine if you really owe it.

  • Federal Court.  In large cases, it might be worth going to Federal Court and seeking an order that the tax is not owed.  These cases require that the amount be significant.  The Tax usually must be paid and a refund claim denied before going to court.

     One thing is for certain: you need help if a tax has been assessed against you and you really don't owe it.
